Retreat and Workshop Participation Disclaimer, Release of Liability, and Media Consent
IMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING
This document serves as a binding agreement between Afterglow Anna (“the Company”), and the undersigned participant (“Participant”), for participation in either the retreats organised by the Company, which include activities such as Kundalini Yoga, Breathwork, Yoga, cold water immersion, guided walking, and trips to various locations including but not limited to Ibiza,
Switzerland, and Thailand, or one-off classes and workshops (“Events”). By participating in any Events organised by the Company, the Participant agrees to the terms outlined in this Disclaimer and Release of Liability, and Media Consent (“Agreement”).
Waiver of Liability: This Agreement releases Afterglow Anna from all liability relating to injuries that may occur during any Events, including but not limited to retreat activities or one-off classes and workshops. By signing this Agreement, I agree to hold Afterglow Anna entirely free from any liability, including financial responsibility for injuries incurred. I acknowledge the risks involved in these activities and understand all the risks stated in this document. I swear that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I declare that I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in these activities. By agreeing below, I forfeit the right to bring legal action against Afterglow Anna for any reason. In return, I will receive participation in the specified activities. I will also make every effort to obey safety precautions as listed in this document and as explained to me verbally. I will ask for clarification when needed.
Health Declaration: Prior to participating in any Events, I declare that I am fit and well, and do not have any health conditions that could be adversely affected by participation. I agree to disclose any pre-existing medical conditions or concerns to the Company before engaging in any activities. This is to ensure my safety and the safety of others during the Events. Media Consent: I hereby grant Afterglow Anna the right to take photographs and video recordings of me during the Events and to use these in all media, including online platforms, for any lawful purpose such as publicity, illustration, advertising, and web content. I understand that I will not receive any compensation for the use of such images or recordings. If I prefer not to have my images or recordings used for these purposes, I will notify Afterglow Anna in writing prior to the commencement of the Event.
1. Acknowledgment of Risks: The Participant acknowledges that participation in the Events carries inherent risks, including but not limited to physical injury, illness, emotional distress, and death. The Participant voluntarily assumes all risks, both known and unknown, associated with their participation.
2. Flights and Travel Arrangements: For retreats, the Company is not responsible for arranging or managing flights or any other travel arrangements required for attending. The Participant is solely responsible for all aspects of their travel, including any cancellations, delays, or additional costs incurred.
3. Medical Considerations: The Participant confirms they are physically and mentally capable of participating in the Events. They have consulted with a healthcare provider regarding their participation, where necessary. The Company is not liable for any medical issues or injuries that arise because of participation in the Events.
4. Extra Costs: For retreats, the Participant understands that any additional costs incurred, not covered by the initial fee, are their responsibility. This includes, but is not limited to, personal expenses, additional activities, and unforeseen costs.
5. Transportation and Car Hire: In instances where the Company provides transportation for retreats, the Participant releases the Company from any liability related to transportation, including accidents or injuries.
6. Accommodation: For retreats, the Events are hosted in rented villas, which are private homes and not commercial hotels. The Participant agrees to respect the property and will be liable for any damages caused during their stay.
7. General Release: The Participant hereby releases and holds harmless the Company, its directors, employees, volunteers, and agents from any claims, demands, or causes of action, which are in any way connected with their participation in the Events.
8. Agreement to Follow Directions: The Participant agrees to follow all instructions given by the Company and its representatives during the Events. Failure to do so may result in exclusion from the Events, without a refund.
9. Governing Law: This Agreement shall be governed by and interpreted in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles.
10. Acknowledgment: By signing this Agreement, the Participant acknowledges that they have read and understood this document and agree to be bound by its terms.
